Supreme Court Stays OSHA ETS Vaccination and Testing Mandate
On Jan. 13, 2022, the Supreme Court of the United States (SCOTUS) ruled to stay the Occupational Safety and Health Administration’s (OSHA) vaccination and testing emergency temporary standard (ETS).
This rule required covered organizations with at least 100 workers to ensure employees are fully vaccinated against COVID-19 or test negative for COVID-19 every week and wear a mask while in the workplace. The U.S. Supreme Court has ruled to stay OSHA’s mandate, stating that OSHA was not given the power to regulate public health more broadly than occupational dangers. This means that employers are not required to comply with the OSHA ETS vaccination and testing mandate at this time.
